Newsletter Terms

This document explains how our email newsletter works, what you consent to when you sign up, and how to unsubscribe. It forms part of our Privacy Policy.

1. Who sends the newsletter

Our newsletter is sent via MAILERLITE acting as our data processor.

2. What you will receive

When you subscribe, you agree to receive:

  • Product news: new arrivals, restocks, Stage releases, technical articles;
  • Promotions: occasional discount codes, sales, bundle offers;
  • Technical content: installation guides, compatibility updates, workshop tips;
  • Company updates: warehouse news, service changes, event attendance.

Frequency: typically 1–4 emails per month. We will not increase this frequency without notice.

We do not send third-party advertising.

3. How you subscribe (and confirm) – double opt-in

  1. You submit your email address through the signup form on our Site (or at checkout, or on our social media).
  2. We send you a confirmation email asking you to click a link to verify your address.
  3. You are only added to the list once you click the confirmation link.

Both actions are required. If you do not confirm, you will not receive further newsletters.

This double opt-in process protects you from unsolicited messages and is required under Art. 6(1)(a) GDPR, §7 of the German UWG, Polish Act of 18 July 2002 on Electronic Services (UŚUDE), and best practice in all other jurisdictions.

We send email marketing on the basis of:

  • Your explicit consent (Art. 6(1)(a) and Art. 7 GDPR), recorded through the double opt-in;
  • For existing customers: limited post-sale follow-ups sent under legitimate interest (Art. 6(1)(f) GDPR) as permitted by Art. 13(2) of the ePrivacy Directive where allowed by your country’s implementation, always with a one-click opt-out in every message.

5. How to unsubscribe

At any time and free of charge. Options:

  • Click “Unsubscribe” at the bottom of any email we send – instant effect;
  • Email newsletter@performanceturbo.eu with the subject “UNSUBSCRIBE”;
  • Log into your account (if you have one) and toggle marketing preferences off.

Withdrawing consent does not affect the lawfulness of processing based on consent before its withdrawal.

Unsubscribing from marketing does not stop transactional emails (order confirmations, shipping updates, warranty notices, legal notices), those are required to fulfil our contract with you.

We do not sell or rent our mailing list. We do not share the list with third parties outside our data processors (our email marketing provider, section 1).

7. International deliverability – CAN-SPAM (US) and CASL (Canada)

7.1. US – CAN-SPAM Act of 2003

Every marketing email we send to US recipients:

  • identifies us truthfully as the sender;
  • displays a valid postal address;
  • displays a clear and conspicuous unsubscribe link;
  • honours unsubscribe requests within 10 business days;
  • does not use deceptive headers or subject lines.

7.2. Canada – CASL

For Canadian recipients, we rely on express consent evidenced by double opt-in. We maintain records of consent for at least 3 years. If you have not given consent but have an “existing business relationship” with us under CASL, we may send transactional messages only.

7.3. Other jurisdictions

We comply with applicable marketing-consent laws in other major markets, including the UK (PECR), Australia (Spam Act 2003), Japan (Act on Specified Commercial Transactions, Act on Regulation of the Transmission of Specified Electronic Mail), and Singapore (PDPA).

8. Retention

  • Active subscribers: data retained for as long as you remain subscribed.
  • Unsubscribed: your email is added to a suppression list and kept only to make sure we don’t accidentally email you again. No marketing is sent to suppressed addresses.
  • Inactive subscribers (no opens or clicks for 24 months): we will attempt a re-engagement email; if no response, we will remove you from the list.

9. Your rights

You have all the rights described in our Privacy Policy (access, correction, deletion, restriction, portability, objection, complaint to the supervisory authority). To exercise any right related to email marketing, email contact@performanceturbo.eu.
