1. Turbochargers are safety-critical components
A turbocharger operates at shaft speeds in excess of 150,000 rpm and exhaust temperatures commonly above 900 °C. Improper installation, oiling, or tuning of a turbocharger can cause, without limitation:
- catastrophic engine failure (bent rods, cracked pistons, damaged cylinder heads);
- under-hood fire;
- ejection of metal fragments;
- vehicle loss of control;
- serious injury or death.
You acknowledge and accept these risks.
2. Professional installation strongly recommended
We strongly recommend that installation be performed by a qualified automotive technician with specific experience in turbocharger systems. You should:
- use the vehicle manufacturer’s workshop manual for torque specifications, oil feed routing, and intake/exhaust procedures;
- replace oil, oil filter, intake boots, and all gaskets before first start;
- prime the oil system at the turbocharger’s oil feed before cranking;
- clear the oil feed line of any debris or contamination;
- run the engine for the required break-in period at idle before driving.
We do not accept responsibility for failure, damage, injury, or loss caused by improper installation, regardless of who performed the installation.
3. Legal compliance is your responsibility
3.1. In all jurisdictions
You are solely responsible for ensuring that the fitting, operation, and road-use of any Product we sell complies with the laws, regulations, and technical standards of the country, state, province, or municipality where the vehicle is registered and operated.
This includes, without limitation:
- roadworthiness inspections (e.g., MOT in the UK, TÜV in Germany, Kontrola Techniczna in Poland, Contrôle Technique in France, Revisione in Italy, ITV in Spain);
- emissions certifications;
- noise limits;
- vehicle modification registration / type approval;
- customs and import classification.
3.2. Effect on manufacturer warranty
Installing an upgraded turbocharger or any non-OEM component may void some or all of your vehicle manufacturer’s warranty. Check your warranty booklet or consult your dealer before proceeding.
3.3. Effect on insurance
You must notify your motor insurance provider of any modification to your vehicle. Failure to disclose modifications may result in your insurance being void, refused claims, or the policy being cancelled. This may be treated as insurance fraud in some jurisdictions.
3.4. Effect on re-sale
Undocumented or unapproved modifications may reduce the vehicle’s value and restrict sale in certain markets.
4. United States – Clean Air Act compliance
This section applies to customers shipping to, or operating vehicles in, the United States.
4.1. Clean Air Act restrictions
Section 203(a)(3) of the US Clean Air Act, 42 U.S.C. §7522, makes it unlawful for any person to manufacture, sell, offer for sale, or install any part or component for a motor vehicle where a principal effect of the part is to bypass, defeat, or render inoperative any device or element of design installed to comply with the Act (a so-called “defeat device”).
Tampering with factory emissions-control equipment – including catalytic converters, diesel particulate filters (DPF), selective catalytic reduction (SCR/AdBlue) systems, exhaust gas recirculation (EGR) valves, oxygen sensors, and engine control software calibrations – is similarly prohibited. Violations can carry substantial civil and criminal penalties.
4.2. Off-road / competition use
Where a Product, if fitted to a vehicle operated on public roads in the United States, would interact with factory emissions-control equipment or require software calibration that alters emissions-control operation, the Product is sold strictly for off-road or competition use on vehicles that are not used on public roads and that are not registered for on-road use.
4.3. Buyer representations – US Customers
By placing an Order for delivery to the United States you expressly represent and warrant that:
(a) you will not install or cause to be installed the Product on any motor vehicle that is registered, operated, or intended to be operated on public roads in the United States in a manner that would violate the Clean Air Act or any regulation of the US Environmental Protection Agency (EPA) or the California Air Resources Board (CARB); and
(b) if the Product is installed on a US-registered on-road vehicle, you will ensure that all factory emissions-control equipment remains fully functional and that any software calibration used is compliant with EPA/CARB requirements (e.g., a CARB Executive Order has been issued for the specific calibration/part combination on your vehicle).
4.4. No EPA or CARB certification
We do not represent that any Product is certified for on-road use by the EPA or CARB unless a specific EPA certification or CARB Executive Order number is displayed on the product page. You must verify the legality of any intended use before purchase.
4.5. Indemnification – US Customers
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless DSTurbo Dawid Sowa and its owners, employees, and agents from and against any claim, fine, penalty, loss, or damages (including reasonable attorneys’ fees) arising out of or relating to your installation or use of the Product on a US-registered on-road vehicle in violation of the Clean Air Act or of any federal, state, or local emissions law.
5. European Union – emissions, homologation, and road use
5.1. Type approval
Most EU Member States require modifications that affect a vehicle’s emissions-related components, engine power output, or safety-critical systems to be registered with the national vehicle authority and/or require re-homologation (a technical inspection certifying that the modified vehicle still meets applicable type-approval and emissions standards).
5.2. Specific national regimes
Requirements differ by country. Examples (not exhaustive):
- Poland: modifications must be entered in the vehicle registration (dowód rejestracyjny) and may require a Kontrola Techniczna test.
- Germany: TÜV inspection and Eintragung in the registration document; parts often need an ABE (Allgemeine Betriebserlaubnis) or Teilegutachten.
- France: réception à titre isolé (RTI) through the DREAL.
- Italy: homologation via the Motorizzazione Civile.
- United Kingdom: for substantial modifications, DVLA notification and re-testing may be required; check current DVLA guidance.
5.3. On-road legality
Products we label as intended for motorsport, track, or off-road use may not be legal for on-road use in your jurisdiction without further modification, approval, or certification. This is your responsibility to verify.
6. Other jurisdictions
Similar rules exist in Canada (CEPA), Japan (MLIT/JATA approvals), Australia (ADRs), and other markets. If you are in a country not listed, consult a local authority or a licensed mechanic before installation.
7. Tuning, ECU calibration, and software
We sell turbochargers only. We do not provide ECU tuning, software maps, or calibration files. Any tune used with our Product is provided by a third party and is your sole responsibility. We accept no liability for damage caused by third-party tuning, including:
- excessive boost pressure,
- excessive EGT,
- improper fuelling,
- incorrect wastegate duty-cycle,
- failure to de-tune before warranty inspection.
8. Power figures are indicative
Published power and torque figures on our Site (e.g., “up to 420–600 HP”) are indicative estimates for a vehicle with a healthy supporting build. Actual results depend on fuel quality, intercooler, intake, exhaust, injectors, fuel pump, clutch, transmission, tuning, and vehicle condition. We do not warrant that you will achieve any specific power figure.
9. No medical, legal, or financial advice
Content on our Site (including blog posts, buying guides, product descriptions) is provided for informational purposes only and does not constitute engineering, medical, legal, financial, or tax advice.
10. Acceptance
By placing an Order, you confirm that you:
- are at least 18 years old and have full legal capacity;
- have read, understood, and accepted this Disclaimer in its entirety;
- will comply with all applicable laws in the installation, operation, and on-road use of the Product;
- accept full responsibility for any legal, financial, or physical consequences of failing to do so;
- release DSTurbo Dawid Sowa from liability for any such consequences, to the maximum extent permitted by applicable law.
